Information Sheet - Appealing a Notice of Proposal,
Notice of Proposed Order or Order of Monetary Penalty issued by the Alcohol and
Gaming Commission of Ontario (AGCO)
Introduction
This document
provides information on appealing a Notice of Proposal, Order of Monetary
Penalty or Notice of Proposed Order issued by the Registrar of the Alcohol and
Gaming Commission of Ontario (AGCO).
Hearings and Appeals under the Liquor Licence Act
Who Can Appeal
Individuals or
businesses who are applying for a licence, or are licensed, under the Liquor
Licence Act and who dispute a Notice of Proposal (NOP) issued by the
Registrar of Alcohol and Gaming (the Registrar) to refuse the application or to
suspend or revoke the licence, or who dispute an Order of Monetary Penalty
(OMP), may appeal to the Licence Appeal Tribunal.
If the Registrar
of the AGCO proposes to refuse, revoke or suspend a licence, the Registrar must
serve a Notice of Proposal (NOP) on the appellant/licensee outlining the
reasons for the proposed action.
Appellants/licensees
who dispute an NOP issued by the Registrar may appeal the proposal to the
Licence Appeal Tribunal.
If the Registrar
of the AGCO issues an Order of Monetary Penalty (OMP), the Registrar must serve
the OMP on the licensee which includes the allegation(s) plus details of the
alleged infraction(s) in the Order. Licensees who dispute an OMP issued by the
Registrar may appeal the Order to the Licence Appeal Tribunal.
How to Appeal
If you received a
NOP or OMP and wish to request a hearing/appeal, you have fifteen (15) days
from the date of receiving the NOP or OMP to submit a written request for a
hearing/appeal to the Licence Appeal Tribunal.
Complete the Notice of Appeal form for AGCO matters
and submit the completed form to the Licence Appeal Tribunal.
Hearings and Appeals under the Gaming Control Act, 1992
Who Can Appeal
Individuals or
businesses who are applying for registration, or who are registered under the Gaming
Control Act, 1992, and who dispute a Notice of Proposed Order (NOPO) issued
by the Registrar of the AGCO to refuse an application or to suspend or revoke a
registration, or dispute an Order of Monetary Penalty (OMP) issued by the
Registrar, may appeal the proposal or Order to the Licence Appeal Tribunal.
If the Registrar
of the AGCO proposes to refuse, revoke or suspend a registration, the Registrar
must serve a Notice of Proposed Order (NOPO) on the appellant/registrant
outlining the reasons for the proposed action.
Appellants/registrants
who dispute a NOPO issued by the Registrar of the AGCO may appeal the proposal
to the Licence Appeal Tribunal.
